Please read this document carefully before placing your order. By finalizing your order, you acknowledge and accept the contents of these Terms and Conditions.

These General Terms and Conditions (“GTC”) govern the use of the online store operated by Yourcontact Ltd. (registered office: 6200 Kiskőrös, Dózsa Gy. Road 52, Hungary; tax number: 14017164-2-03), hereinafter referred to as the “Service Provider”.

Please use our services only if you agree with all provisions of these Terms and Conditions and consider them binding upon yourself.

This document is concluded exclusively in electronic form and is not filed by the Service Provider. It does not constitute a written contract and does not refer to any code of conduct.

2. General Provisions

Scope and Acceptance of the Terms and Conditions

The content of the contract concluded between the Customer and the Service Provider is determined by these General Terms and Conditions (hereinafter referred to as the “GTC”), in addition to the applicable mandatory legal provisions.

Accordingly, these GTC define:

  • the rights and obligations of both parties;
  • the conditions for concluding a contract;
  • delivery deadlines;
  • payment and shipping terms;
  • liability rules;
  • and the conditions for exercising the right of withdrawal.

Technical information required for using the website that is not included in these GTC is provided elsewhere on the website.

Before finalizing an order, the Customer is required to familiarize themselves with these Terms and Conditions.

By purchasing through our online store, the Customer accepts these GTC, which become an integral part of the contract concluded between the Customer and the Service Provider.

 

3. Products and Services Available for Purchase

The essential characteristics of the products offered for sale are described on the respective product pages.

The minimum order value is EUR 30 net, or the minimum order quantity specified on the individual product page.

Orders may be cancelled before confirmation is approved. Cancellation requests must be submitted in writing to the Service Provider.

 

3.1 Correction of Data Entry Errors – Responsibility for the Accuracy of Information Provided

During the ordering process, the Customer may continuously modify the information entered before finalizing the order. By clicking the browser’s “Back” button, the previous page can be reopened, allowing corrections even after proceeding to the next page.

The Customer is solely responsible for ensuring that all information provided is accurate and complete, as invoices and deliveries will be processed based on the information submitted.

By placing an order, the Customer acknowledges that the Service Provider is entitled to charge the Customer for any damages or costs resulting from incorrect or inaccurate data provided by the Customer.

The Service Provider shall not be held liable for any issues arising from inaccurate information supplied by the Customer.

Please note that an incorrectly entered email address or a full mailbox may prevent delivery of the order confirmation and may consequently prevent the contract from being concluded.

 

3.2 Procedure in the Event of Incorrect Pricing

The following are considered obviously incorrect prices:

  • A price of EUR 0;
  • A discounted price where the discount has been incorrectly displayed (for example, a product originally priced at EUR 5 advertised with a 50% discount but offered for EUR 1).

If an incorrect price is displayed, the Service Provider shall offer the Customer the opportunity to purchase the product at the correct price.

Upon receiving this information, the Customer may choose to:

  • purchase the product at the correct price; or
  • cancel the order without any adverse legal consequences.

4. Registration / Purchase

4.1 Registration

Registration is not required in order to make a purchase in our online store.

During the purchasing process, you will be required to provide the information necessary to complete your order, including your name, billing and shipping details, and email address.

If you choose to register, you must also accept the registration terms and conditions. The registration will be confirmed by email.

Customers are responsible for keeping their password confidential. If, during the identification process, a customer’s unique identifier and password are correctly entered and the customer’s data subsequently becomes available to an unauthorized third party, the Data Controller shall not be liable for any resulting damages or disadvantages.

By providing their email address, users consent to receiving technical and service-related communications from the operator/service provider.

Upon request, the operator will delete registered user data from the system. For security reasons, deletion requests will only be processed if confirmed by the user via email. This measure helps prevent unauthorized or accidental deletion of another user’s registration data.

Registration is identified by the user’s email address; therefore, a single email address may only be registered once.

Registration does not create any purchasing obligation.

4.2 Purchase

By clicking on the product categories displayed on the website, you may select the desired product group and individual products.

Each product page contains:

  • Product images;
  • Product code/SKU;
  • Product description;
  • Product price.

All prices displayed on the website are net prices and do not include VAT or shipping costs.

Products are illustrated with photographs. Actual colors may differ from those displayed on the website depending on monitor and device settings.

Accessories and decorative elements shown in photographs are not included with the product unless expressly stated in the product description.

Please note that we assume no liability for typographical errors or incorrect information displayed on the website.

5. Ordering Process

After selecting a product, you may add any number of items to your shopping cart by clicking the “Add to Cart” button.

Adding products to the cart does not create any purchase or payment obligation and does not constitute a binding offer.

Products may be added to the cart and purchased without registration.

If you are a registered customer and have forgotten your password, you may use the password recovery function. By entering your registered email address, your password reset instructions will be sent to you by email.

You may log in through the “Login” menu by entering your registered email address and password.

After successful login, your registered email address and a logout option will appear within your account.

At any time while browsing the website, you may review the contents of your cart by clicking the cart icon located at the top of the page.

Within the cart, you may:

  • Remove products;
  • Modify quantities;
  • Review prices and order details.

After clicking the “Update Cart” button, the system will display the updated information, including revised pricing.

If you do not wish to add additional products, you may continue the purchasing process by clicking “Proceed to Checkout”.

The checkout page displays:

  • Cart contents;
  • Total purchase price;
  • Customer information fields.

The customer must then provide the required information, including:

  • Name;
  • Address;
  • Shipping method;
  • Payment method;
  • Contact information.

 

5.1 Finalizing the Order (Submitting an Offer)

If you have verified that:

  • The contents of your cart are correct;
  • The selected products are accurate;
  • Your personal and billing information has been entered correctly,

you may finalize your order by clicking the “Submit Order” button.

Information displayed on the website does not constitute a contractual offer by the Service Provider.

For orders governed by these Terms and Conditions, the Customer is considered the offeror.

By clicking “Submit Order”, you expressly acknowledge that your order constitutes a binding offer and that, if accepted by the Service Provider, it creates a payment obligation.

Your offer remains binding for a period of 48 hours.

If the Service Provider does not confirm your order within 48 hours in accordance with these Terms and Conditions, you shall no longer be bound by your offer.

 

5.2 Order Processing and Conclusion of the Contract

Orders may be submitted at any time.

The Service Provider will confirm receipt of your order by email no later than the next business day following submission of your offer.

The contract is deemed concluded when the confirmation email sent by the Service Provider becomes accessible to you through your email system.

6. Payment and Delivery Terms

6.1 Payment Methods

Bank Transfer (Advance Payment)

If your order has been confirmed, our bank account details and your order reference number will be included in the confirmation email.

Please indicate the order number in the payment reference field when making the transfer.

Products will only be dispatched after the transferred amount has been credited to our bank account.

 

Personal Collection and Payment

Customers may also pay for their order in cash (HUF) upon personal collection at the Service Provider’s registered office or premises.

For personal collection, an appointment must always be arranged in advance.

 

Cash on Delivery (COD)

Products will be delivered to the address specified by the Customer through our contracted courier service, GLS Hungary.

The invoice amount for the ordered product(s) must be paid directly to the courier upon delivery.

For cash-on-delivery orders, an additional COD fee will be added to the shipping costs.

Payment must be made in cash at the time of delivery.

 

Credit Card Payment (Barion)

Online credit card payments and other electronic payment methods are processed through the Barion payment system.

Credit card and payment information is not transmitted to the merchant.

The payment service is provided by Barion Payment Ltd., a financial institution supervised by the National Bank of Hungary.

The total amount payable, as shown in the order summary and confirmation email, includes all applicable charges.

Electronic invoices will be sent to the email address provided by the Customer.

Upon delivery, please inspect the package in the presence of the courier.

If you notice any damage or missing items, request that a damage report be completed and refuse acceptance of the shipment.

Unfortunately, we are unable to accept claims submitted after delivery if no official damage report was prepared at the time of receipt.

 

6.2 Delivery Methods and Shipping Fees

Home Delivery Charges

  • Orders up to EUR 200 (net): EUR 15 + VAT per package
  • Orders above EUR 200 (net): Free delivery

For cash-on-delivery orders, the applicable COD fee will be added to the shipping costs.

 

Delivery Time

For products that are in stock, delivery is typically completed within 2 business days from the date of order confirmation.

For orders paid by bank transfer, the delivery period begins once the payment has been received and credited to our bank account.

If a product is temporarily out of stock, the Customer will be informed separately regarding the expected availability and delivery timeframe.

7. Right of Withdrawal

Consumer Information Pursuant to Government Decree 45/2014 (II.26.)

7.1 Information on the Consumer’s Right of Withdrawal

Under Section 8:1 (1) 3 of the Hungarian Civil Code, only a natural person acting outside their trade, profession, or business activity qualifies as a consumer. Therefore, legal entities are not entitled to exercise the right of withdrawal without cause.

Pursuant to Section 20 of Government Decree 45/2014 (II.26.), consumers have the right to withdraw from the contract without providing any reason.

The consumer may exercise the right of withdrawal:

  • In the case of a contract for the sale of goods, from the date on which the product is received;
  • In the case of multiple products delivered separately, from the date on which the last product is received;

by the consumer or a third party designated by the consumer, other than the carrier.

The withdrawal period is 14 calendar days.

The provisions of this section do not affect the consumer’s right to exercise the right of withdrawal during the period between the conclusion of the contract and receipt of the product.

Where the contract is concluded based on an offer made by the consumer, the consumer has the right to withdraw the offer before the contract is concluded, thereby terminating the binding effect of the offer.

 

7.2 Withdrawal Notice and Exercise of the Right of Withdrawal

The consumer may exercise the right of withdrawal granted under Section 20 of Government Decree 45/2014 (II.26.) by submitting a clear and unambiguous statement of withdrawal.

7.3 Validity of the Withdrawal Notice

The right of withdrawal shall be deemed exercised within the statutory period if the consumer sends the withdrawal notice before the expiry of the 14-day withdrawal period.

The burden of proving that the withdrawal right was exercised in accordance with these provisions rests with the consumer.

Where the Service Provider enables consumers to exercise their withdrawal right through its website, the Service Provider shall promptly acknowledge receipt of the withdrawal notice on a durable medium (e.g., email).

 

7.4 Cases Where the Right of Withdrawal Cannot Be Exercised

The Service Provider expressly informs customers that the right of withdrawal cannot be exercised in the cases listed in Section 29(1) of Government Decree 45/2014 (II.26.), including but not limited to:

  • Contracts for the provision of services after the service has been fully performed, provided that performance began with the consumer’s prior express consent and acknowledgment that the right of withdrawal would be lost upon full performance;
  • Products that are not prefabricated and have been manufactured based on the consumer’s instructions or explicit request;
  • Products that have been clearly customized or personalized for the consumer.

 

8. Warranty, Guarantee and Statutory Product Liability

We provide a warranty for our products for the period required by applicable law, subject to presentation of the original invoice.

The warranty does not cover defects resulting from improper use, misuse, or inappropriate storage.

The colors displayed on the website are for illustrative purposes only. Minor color variations may occur.

 

8.1 When May the User Exercise Rights Under the Statutory Warranty for Defects?

In the event of defective performance by the Service Provider, the User may assert a statutory warranty claim against the Service Provider in accordance with the provisions of the Hungarian Civil Code.

 

8.2 What Rights Does the User Have Under a Statutory Warranty Claim?

The User may, at their discretion:

  • Request repair; or
  • Request replacement.

The chosen remedy may be refused if it is impossible or would result in disproportionate additional costs compared to another available remedy.

 

8.3 Within What Time Limit Can a Statutory Warranty Claim Be Enforced?

Consumers must notify the Service Provider of the defect without undue delay after its discovery, but no later than two months from the date the defect was identified.

 

8.4 Against Whom May a Statutory Warranty Claim Be Enforced?

The User may assert statutory warranty claims directly against the Service Provider.

 

Product Liability

8.5 When May the User Exercise Product Liability Rights?

In the event of a defect in a movable product, the User may choose between:

  • A statutory warranty claim; or
  • A product liability claim.

 

8.6 What Rights Does the User Have Under Product Liability?

Under product liability rules, the User may only request:

  • Repair of the defective product; or
  • Replacement of the defective product.

 

8.7 When Is a Product Considered Defective?

A product is considered defective if:

  • It does not comply with the quality requirements applicable at the time it was placed on the market; or
  • It does not possess the characteristics described by the manufacturer.

Differences between colors displayed on a monitor and the actual product shall not be considered product defects.

 

8.8 Against Whom and Under What Conditions May a Product Liability Claim Be Enforced?

A product liability claim may only be asserted against the manufacturer or distributor of the product.

The User bears the burden of proving the existence of the defect.

 

8.9 When Is the Manufacturer (or Distributor) Exempt from Product Liability?

The manufacturer or distributor shall be exempt from product liability if it can prove that:

  • The product was not manufactured or distributed in the course of its business activities; or
  • The defect could not have been detected based on the state of scientific and technical knowledge at the time the product was placed on the market; or
  • The defect resulted from compliance with mandatory legal or regulatory requirements.

Proof of any one of the above circumstances is sufficient to establish exemption.

Please note that warranty claims and product liability claims regarding the same defect cannot be asserted simultaneously.

However, if a product liability claim is successfully enforced, the User may subsequently assert warranty claims against the manufacturer with respect to the replacement product or repaired component.

 

9. Miscellaneous Provisions

Any matters not regulated by these General Terms and Conditions shall be governed by:

  • Act V of 2013 on the Civil Code of Hungary;
  • Government Decree 45/2014 (II.26.) on contracts concluded between consumers and businesses at a distance.

 

9.1 Retention of Title

Ownership of the delivered goods shall remain with Yourcontact Marketing & Advertising Agency Ltd. until the full purchase price has been paid in full.
